2. Customer Accounts

Customers are responsible for protecting their account credentials and for activity carried out through their account.

Customers must notify Apex Hosting if they believe their account has been compromised or accessed without authorisation.

3. Acceptable Use

Apex Hosting services must be used lawfully and responsibly.

Customers may not use our services for illegal, fraudulent, malicious or abusive activities, or in any way that compromises our infrastructure or negatively affects other customers.

4. Domains

Domain registrations and renewals are subject to the requirements and policies of the relevant domain registry.

Apex Hosting cannot guarantee the availability of a domain until registration has been successfully completed.

Customers are responsible for providing accurate domain information and complying with applicable domain requirements.

5. Payments and Billing

Customers must pay all charges by the applicable due date.

Customers are responsible for maintaining accurate billing information and ensuring that payment methods remain valid.

Services may be suspended for unpaid amounts in accordance with applicable law and our Refund & Cancellation Policy.

Apex Hosting may change pricing for future billing periods where permitted by law.

6. Suspension and Termination

Apex Hosting may suspend or terminate services where reasonably necessary, including for:

  • Non-payment;
  • Material breach of these Terms;
  • Illegal or fraudulent activity;
  • Abuse of our services or infrastructure;
  • Serious security concerns; or
  • Other circumstances permitted by the applicable service agreement.

Where reasonably possible, we will provide notice before suspension or termination.

Customers may cancel services in accordance with our Refund & Cancellation Policy.

7. Service Availability

Apex Hosting aims to provide reliable hosting services but cannot guarantee uninterrupted availability in every circumstance.

Services may be affected by maintenance, technical failures, network interruptions, security incidents, third-party services or circumstances beyond our reasonable control.

Any specific uptime guarantee or service-level commitment applies only where expressly stated for the relevant service.

8. Backups

Where backups are included with a service, they are provided as a recovery facility.

Customers should maintain their own independent backups of important websites, databases, email and other data.

Apex Hosting does not guarantee that every item of customer data will always be recoverable from a backup.

9. Customer Content

Customers retain ownership of the content and data they upload to Apex Hosting.

Customers are responsible for ensuring that they have the necessary rights and permissions to store and publish their content.

Apex Hosting may access or process customer data where reasonably necessary to provide, maintain, secure or support the contracted services, subject to our Privacy Policy.

10. Intellectual Property

The Apex Hosting name, logo, website content, graphics, designs and other Apex Hosting intellectual property may not be copied, reproduced or commercially used without permission, except where permitted by law.

Third-party trademarks, software and services remain the property of their respective owners.

11. Third-Party Services

Apex Hosting may use or integrate with third-party software, infrastructure, payment providers, domain registries and other services.

Third-party services may be subject to their own terms and policies. Apex Hosting is not responsible for interruptions or changes to third-party services outside our reasonable control.

12. Limitation of Liability

To the maximum extent permitted by law, Apex Hosting will not be liable for indirect, incidental or consequential losses arising from the use of our services.

Customers must provide accurate registration information and comply with applicable domain policies.

Certain domain extensions may have additional registration, verification, transfer or dispute-resolution requirements.

Where a registry's policies apply to a domain, those policies may take precedence over Apex Hosting's general domain-service procedures.


8. Copyright and Intellectual Property

Apex Hosting respects intellectual-property rights.

Customers are responsible for ensuring that websites, files, media, software and other content hosted through our services do not unlawfully infringe the intellectual-property rights of others.

Where Apex Hosting receives a valid legal complaint, court order or other legally recognised notice concerning potentially unlawful content, we may take appropriate action in accordance with applicable law.

This Refund & Cancellation Policy explains the cancellation and refund terms applicable to services purchased from Apex Hosting ("Apex Hosting", "we", "us" or "our").

This policy should be read together with our Terms of Service and the terms applicable to the specific service purchased.


1. Cancellation of Services

Customers may request cancellation of an Apex Hosting service by contacting Apex Hosting through the available support or account-management channels.

Cancellation requests should be submitted before the next billing date to avoid the service being renewed.

Unless otherwise agreed, cancellation will take effect at the end of the customer's current paid service period.


2. Refund Eligibility

Refunds are considered according to the type of service purchased and the circumstances of the cancellation.

Where a refund is applicable, Apex Hosting will process the approved refund using the original payment method where reasonably possible.

Refunds are subject to any mandatory consumer rights applicable under South African law.


3. Hosting Services

For eligible web hosting services, Apex Hosting may offer a 10-day money-back guarantee from the date of initial service activation.

To qualify:

  • The request must be submitted within 10 days of initial activation;
  • The account must not have been terminated for abuse, fraud or violation of our policies; and
  • The refund request must relate to the initial hosting purchase.

The money-back guarantee does not automatically apply to renewals, upgrades, add-ons or other separately purchased services.


4. Professional Email Services

Professional Email services are generally eligible for cancellation at the end of the current billing period.

Refund eligibility for Professional Email services depends on the applicable billing period and whether the service has already been activated.

Any applicable statutory consumer rights remain unaffected.


5. Domain Registrations

Domain registration fees are generally non-refundable once a domain registration has been successfully completed.

This includes:

  • New domain registrations;
  • Domain renewals;
  • Domain transfers where the applicable registry fee has already been incurred; and
  • Other registry charges that have already been paid.

This is because domain registration fees are generally paid to third-party registries or registrars on the customer's behalf.

Where a domain registration cannot be completed and the relevant registration fee has not been incurred, the applicable amount may be refunded.


6. SSL Certificates and Third-Party Services

Fees paid for third-party products or services may be non-refundable once the service has been activated or the applicable third-party charge has been incurred.

This may include certain:

  • SSL certificates;
  • Software licences;
  • Third-party services;
  • Registry services; and
  • Other externally provided products.

Where a third-party provider issues a refund to Apex Hosting, the corresponding customer refund will be considered accordingly.


7. Add-Ons and Upgrades

Add-ons, upgrades and additional services are subject to the refund terms applicable to the specific product.

Where an upgrade is purchased during an existing billing period, any credit or adjustment will be calculated according to the applicable billing arrangement.


8. Promotional Offers

Promotional pricing, discounts, credits and special offers may have additional terms.

Where a promotional offer includes a free or discounted domain or other benefit, cancellation may affect eligibility for that promotional benefit.

Promotional benefits cannot generally be exchanged for cash unless expressly stated.


9. Refunds Following Service Suspension or Termination

A refund is not automatically provided when a service is suspended or terminated.

Where a service is suspended or terminated because of:

  • Policy violations;
  • Abuse;
  • Fraud;
  • Illegal activity;
  • Security-related concerns; or
  • Other serious breaches of the applicable terms,

Apex Hosting may decline a discretionary refund, subject to any rights the customer has under applicable law.


10. Failed or Late Payments

Customers are responsible for ensuring that payments are made by the applicable due date.

A failed payment may result in:

  • Payment reminders;
  • Temporary service suspension;
  • Renewal failure;
  • Domain-related restrictions; or
  • Termination of the affected service.

Customers remain responsible for amounts properly due under their service agreement.


11. Refund Processing

Approved refunds will normally be processed within a reasonable period after approval.

The time required for the funds to appear in the customer's account may depend on the payment provider or financial institution.

Apex Hosting is not responsible for delays caused by banks or payment providers outside our reasonable control.


12. How to Request a Refund

To request a refund, contact Apex Hosting using the support or billing contact details provided on our website or customer portal.

Please include:

  • Your name;
  • Customer account details;
  • The affected service;
  • The date of purchase;
  • The reason for the refund request; and
  • Any other information reasonably required to process the request.

Apex Hosting may verify the account holder's identity before processing a refund.


13. Statutory Consumer Rights

Nothing in this policy is intended to remove, restrict or replace any rights a customer may have under applicable South African consumer-protection legislation.

Where mandatory legal rights provide a customer with a remedy that differs from this policy, those statutory rights will apply.

This policy should be read together with our Terms of Service and any other policies applicable to the specific service purchased.

By using Apex Hosting services, the customer agrees to comply with this AUP.

1. Prohibited Sites and Activities

Apex Hosting services must not be used to host, store, transmit, distribute or facilitate content or activities that are illegal, abusive, malicious or otherwise prohibited under this AUP.

Prohibited activities include, but are not limited to:

  • Pirated software, copyrighted material distributed without authorization, unlicensed files or other infringing content;
  • Torrent download trackers or services primarily intended to facilitate unauthorized file sharing;
  • Phishing pages, phishing campaigns or websites designed to obtain passwords, payment information or other sensitive information fraudulently;
  • Malware, viruses, ransomware, trojans, worms or other malicious software;
  • Malicious scripts, exploit frameworks or tools used to compromise or damage systems;
  • Unsolicited commercial email, including spam or mass-mailing scripts operated without appropriate authorization;
  • Content or activities that intentionally interfere with the operation or security of Apex Hosting systems or third-party systems;
  • Fraudulent, deceptive or abusive activities; and
  • Any activity that violates applicable laws or regulations.

2. Illegal Activities

Apex Hosting services may not be used for activities that violate applicable laws or regulations.

Customers are responsible for ensuring that their websites, applications, files, communications and other content comply with all applicable legal requirements.

Where Apex Hosting becomes aware of activity that appears to involve illegal conduct, we may take appropriate action, including suspension or termination of the affected service, subject to applicable law.

3. Malware, Phishing and Security Abuse

Customers must not use Apex Hosting infrastructure to distribute, operate or facilitate malicious software or security attacks.

This includes:

  • Malware distribution;
  • Phishing websites or campaigns;
  • Credential harvesting;
  • Malicious redirects;
  • Botnet-related activity;
  • Exploit delivery;
  • Unauthorized access attempts;
  • Brute-force attacks;
  • Denial-of-service attacks;
  • Malicious scanning of third-party systems; and
  • Other activities intended to compromise, disrupt or gain unauthorized access to systems or networks.

Customers are responsible for securing applications, websites, accounts and software operated through their hosting services.

4. Spam and Email Abuse

Apex Hosting services must not be used to send unsolicited bulk or commercial email.

Customers must ensure that email communications comply with applicable laws, regulations and accepted industry practices.

The use of hosting resources for mass-mailing scripts, spam campaigns, purchased mailing lists or other abusive email practices is prohibited.

Apex Hosting may restrict or suspend email services where activity creates a significant risk to our network, mail infrastructure, reputation or other customers.

5. Copyright and Intellectual Property

Customers must not use Apex Hosting services to store, distribute or make available content that infringes the intellectual-property rights of another person or organization.

This includes unauthorized distribution of:

  • Software;
  • Movies and television content;
  • Music;
  • Books and publications;
  • Games;
  • Images;
  • Databases;
  • Website content; and
  • Other copyrighted or protected material.

Customers are responsible for obtaining all necessary permissions, licences or rights for content hosted through their services.

6. Resource Usage

Apex Hosting services may operate on infrastructure where resources such as CPU, memory, storage, network bandwidth and disk I/O are shared between customers.

Customers must use resources reasonably and must not operate activities that materially interfere with the performance, stability or availability of services for other customers.

Activities that may be restricted or prohibited include:

  • Cryptocurrency mining;
  • Continuous high-load background processing;
  • Public file-sharing mirrors;
  • Large-scale automated scraping;
  • Resource-intensive automated tasks;
  • Processes that continuously consume excessive CPU or memory; and
  • Any other activity that places an unreasonable or sustained load on shared infrastructure.

Apex Hosting may investigate unusual resource consumption and may request that the customer reduce or modify the affected activity.

7. Server and Network Security

Customers must not attempt to compromise, disrupt or interfere with the security or operation of Apex Hosting systems, networks or infrastructure.

Prohibited activities include:

  • Unauthorized access attempts;
  • Port scanning or vulnerability scanning of systems without authorization;
  • Network attacks;
  • Denial-of-service or distributed denial-of-service attacks;
  • Exploitation of vulnerabilities;
  • Circumvention of security controls;
  • Unauthorized access to another customer's account or data; and
  • Attempts to interfere with network availability or stability.

Customers must also take reasonable steps to prevent their services from being compromised and subsequently used for malicious activity.

8. Third-Party Abuse

Customers must not use Apex Hosting services to attack, harass, compromise or interfere with third-party systems, networks, websites or services.

This includes using Apex Hosting infrastructure to launch attacks against external organizations, distribute malicious traffic or conceal abusive activity.

Apex Hosting may respond to credible abuse reports involving customer services and may take reasonable measures to protect our infrastructure and other customers.

9. Website and Application Content

Customers are responsible for all content, software, applications and data hosted through their accounts.

Customers must ensure that websites and applications:

  • Do not contain prohibited material;
  • Do not facilitate illegal activity;
  • Do not distribute malware or malicious code;
  • Do not intentionally compromise third-party systems;
  • Do not violate applicable intellectual-property rights; and
  • Comply with applicable laws and regulations.

Apex Hosting does not generally monitor customer content proactively but may investigate or take action where we receive credible reports, detect security threats or otherwise become aware of activity that may violate this AUP.

10. Account Security

Customers are responsible for maintaining the security of their account credentials and services.

Customers should use strong passwords, keep software up to date and take reasonable precautions to prevent unauthorized access.

If a customer becomes aware that their account or hosting service has been compromised, they should notify Apex Hosting as soon as reasonably possible.

Apex Hosting may temporarily restrict an account where necessary to prevent further abuse, compromise or damage.

11. Abuse Reports

Apex Hosting may receive reports relating to alleged abuse, security incidents, copyright infringement, spam, malware or other prohibited activities.

Where appropriate, Apex Hosting may investigate the report and contact the affected customer for additional information or corrective action.

Customers are expected to cooperate reasonably with investigations involving their services.

Failure to address confirmed abusive activity may result in suspension or termination of the affected service.

12. Suspension and Termination

Apex Hosting may suspend, restrict or terminate a service where we reasonably believe that the service is being used in violation of this AUP, our Terms of Service or applicable law.

This may include circumstances involving:

  • Illegal activity;
  • Malware or phishing;
  • Spam;
  • Fraud;
  • Security attacks;
  • Copyright infringement;
  • Excessive resource usage;
  • Network abuse;
  • Repeated abuse complaints; or
  • Other serious or material policy violations.

Where necessary to protect our infrastructure, customers or third parties, suspension may occur without prior notice.

Where appropriate and reasonably possible, Apex Hosting may provide the customer with an opportunity to correct the violation.

13. No Refund Following Policy Violations

Where a service is suspended or terminated because of abuse, fraud, illegal activity, security concerns or a serious violation of this AUP or the applicable Terms of Service, Apex Hosting may decline a discretionary refund.

Nothing in this section is intended to remove or restrict any mandatory rights available to customers under applicable law.

14. Customer Responsibility

Customers are responsible for all activity conducted through their accounts and services, including activity performed by authorized users, employees, contractors or other persons given access to the customer's account.

Customers should take reasonable steps to prevent unauthorized use of their services.

A customer may be held responsible for activity originating from their account where they failed to take reasonable security measures or failed to address known abuse.

15. Cooperation with Legal and Security Requests

Apex Hosting may take reasonable steps to comply with valid legal requirements, court orders, regulatory requests or legitimate security investigations.

Where permitted by law, Apex Hosting may provide information or take action necessary to protect our infrastructure, customers or third parties.

Nothing in this AUP requires Apex Hosting to take action that would violate applicable law.

16. Enforcement

Apex Hosting will determine, acting reasonably, whether activity violates this AUP.

Depending on the circumstances, enforcement measures may include:

  • Requesting removal or modification of prohibited content;
  • Requesting corrective action;
  • Restricting specific services or resources;
  • Suspending network access;
  • Suspending the affected account;
  • Terminating the affected service; or
  • Terminating the customer's account.

The seriousness, frequency and potential impact of the violation may be considered when determining the appropriate response.

17. Changes to This Policy

Apex Hosting may update this Acceptable Use Policy from time to time to reflect changes in our services, infrastructure, security requirements, applicable laws or business practices.

The latest version will be published on the Apex Hosting website.

Continued use of Apex Hosting services following an update constitutes acceptance of the revised policy, subject to any rights provided by applicable law.

By submitting a request for access to records, the requester agrees to comply with the requirements and procedures set out in this Manual and the applicable legislation.

1. COMPANY OVERVIEW

Apex Hosting operates as an internet services and web hosting provider within South Africa.

Apex Hosting may hold records relating to its business operations, customers, services, communications, administration and other activities conducted in the ordinary course of business.

2. CONTACT DETAILS

All requests for access to records under PAIA must be directed to the Information Officer of Apex Hosting.

Requests may be submitted via:

  • Our official website contact form; or
  • Our primary support inbox.

The requester should provide sufficient information to enable Apex Hosting to identify the records being requested and to communicate with the requester regarding the request.

3. REQUIRING ACCESS TO RECORDS

To request access to records, individuals must:

  • Complete the prescribed Form 2 available from the Information Regulator;
  • Submit the completed form to Apex Hosting through the applicable contact channel;
  • Clearly identify the record or records being requested;
  • Clearly state the right that the requester seeks to exercise or protect through access to the requested record; and
  • Pay any applicable statutory fees, where required.

Apex Hosting will consider requests in accordance with PAIA and other applicable laws and regulations.
